Who is subject to the 2010 RTW Law?

If you meet the following criteria, you are in the 2010 RTW Group and subject to the 2010 RTW Law (La. R.S. 11:710).
  • Individuals who retired before July 1, 2020
NOTE: Some individuals who retired before July 1, 2020 are in the 2020 RTW Group because the date of their first reemployment was on or after July 1, 2020. Under Acts 549 and 601 of 2022, these individuals can now elect to transfer to the 2010 RTW Group. The transfer is not available to anyone who previously exercised an option to transfer from the 2010 Group to the 2020 Group. Retirees in the special transfer group who elect to transfer from the 2020 RTW Group to the 2010 RTW Group cannot transfer back to the 2020 RTW Group until July 1, 2027.

Retirees in the 2010 RTW Group can make an irrevocable election to be in the 2020 RTW Group, making them subject to the 2020 RTW Law (La. R.S. 11:710.1).

How does the 2010 RTW Law (La. R.S. 11:710) affect me?

TRSL retirees in the 2010 RTW Group who return to work in positions eligible for TRSL membership can be reemployed in one of four categories: (1) Core Subjects (Math, Science, English Language Arts, Special Education, excluding Gifted/Talented); (2) Special Leave; (3) "Retired Teacher;" or (4) "Retired Member."

Payment of retirement contributions and receipt of retirement benefits are determined by the category to which the return-to-work retiree belongs. TRSL encourages you to contact your potential employer's personnel office to find out which category they may use to re-employ you.
 
Payment of retirement contributions during reemployment: 
  • Employee and employer contributions are required on compensation received while reemployed under the Core Subjects, Special Leave, or "Retired Teacher" categories. Upon terminating reemployment, retirees can apply for a refund of their employee contributions.
  •  Employee and employer contributions are not required during reemployment when a retiree is subject to the “Retired Member” category.
Receipt of retirement benefits during reemployment: 
  • Retirees who are reemployed in a position eligible for TRSL membership and are hired using the Core Subjects, Special Leave, or "Retired Teacher" category, can continue to receive their TRSL retirement benefits, though in some scenarios, an earnings limit may apply.   
  • Retirees who are reemployed in a position eligible for TRSL membership and are categorized as a "Retired Member" will have their TRSL benefits suspended for the duration of reemployment. 
​​​​Service credit during reemployment:
  • No additional service credit is accrued, nor is any additional benefit earned during reemployment under the 2010 RTW Law.

 Which category can I be reemployed in?

If you meet any of the criteria listed below, you may be eligible for the Core Subjects, Special Leave or "Retired Teacher" categories. Otherwise, you are considered a "Retired Member."

CORE SUBJECTS: 
The retiree must be certified in one of the subjects below, and employed to fill a position in the area of certification: (1) Math; (2) English Language Arts; (3) Science; or (4) Special Education (excluding gifted/talented)

SPECIAL LEAVE: 
The retiree must meet the following eligibility criteria: (1) certified; (2) at least age 62; and (3) have at least 30 years of creditable service. Additionally, the retiree must be reemployed to fill a vacancy due to one of the following special leave scenarios: (1) Maternity Leave as defined in La. R.S. 17:1211; (2) Military Leave as defined in La. R.S. 11:1215; (3) Sabbatical Leave as defined in La. R.S. 17:1171; or (4) Extended Sick Leave as defined in La. R.S. 17:1202.

RETIRED TEACHER - Reemployment eligible retiree:
  • Retired on or before June 30, 2010 (grandfathered group).
  • Retiree with an advanced degree in speech therapy, speech pathology, or audiology.

RETIRED TEACHER - Reemployment eligible position (subject to an earnings limit of 25% of annual retirement benefit):      

  • Returning to work as a substitute PreK-12 “classroom teacher."
  • Returning to work instructing adults in an adult education or literacy program administered through a public institution of elementary and secondary education. Retiree must hold a valid Louisiana teaching certificate.
  • Returning to work as an adjunct professor, as defined in La. R.S. 11:710(A)(1).
  • Returning to work as a school nurse, as defined in La. R.S. 17:28.
  • Returning to work as a presenter of professional development training.
  • Returning to work as a tutor for any PreK-12 student.
  • Returning to work as a "classroom teacher" employed in a temporary capacity to proctor tests.
RETIRED TEACHER - Reemployment eligible critical shortage position (NEW PROVISION - 'assessment' positions are now eligible for part-time reemployment under critical shortage):
  • Returning to work (full- or part-time) as a PreK-12 “classroom teacher” in a declared critical shortage area. For both full-time and part-time positions, retiree must be certified in the subject area of the critical shortage. 
  • Returning to work as a full- or part-time certified speech therapist, speech pathologist, audiologist, educational diagnostician, school social worker, school counselor, school psychologist, interpreter, educational transliterator, or educator for the deaf or hard of hearing in a school district where a shortage exists. The position of employment must require a valid Louisiana ancillary certificate approved and issued by the Louisiana Department of Education.
What is a "classroom teacher?" Any employee (1) whose position of employment requires a valid Louisiana teaching certification, and (2) who is assigned the professional activities of instructing pupils in courses in classroom situations for which daily pupil attendance figures for the school system are kept; or is assigned to proctor admissions, evaluation, or assessment testing.
RETIRED MEMBER: Reemployed retirees who do not meet the eligibility criteria for reemployment in the Core Subjects, Special Leave, or "Retired Teacher" categories are categorized as "Retired Members." This includes, but is not limited to, retirees returning to work as teachers in non-critical shortage areas, administrators, and secretaries.

Receipt of retirement benefits during reemployment:  TRSL benefits are suspended for the duration of reemployment, including reemployment by contract or corporate contract.

Payment of retirement contributions during reemployment:  Employee and employer contributions are not required during reemployment.
